SEM Company: Jury Awards $3.1 Million to Family of Motorcycle Rider Killed by Drunk Driver

On April 4, 2013, 27-year-old Calvin M. Wilson Jr. was struck by a car and killed while riding his motorcycle on Belmont Ave. in Philadelphia. A jury recently awarded Wilson’s estate $1.85 million in survival act damages and $1.25 million in wrongful death damages after finding that Kahlile Gray, the defendant in a personal injury lawsuit filed on behalf of Wilson’s estate, was 100% responsible for causing the deadly motorcycle accident. Wilson was riding straight through an intersection with a green light when Gray made a left hand turn across traffic and struck the motorcycle. Wilson was thrown from his bike and rushed to the hospital where he was pronounced dead. Gray was driving with a blood alcohol level above the legal limit and had open alcoholic beverages in his vehicle at the time of the accident.

The attorney for Wilson’s estate is now planning to file a bad-faith claim against American Independence Insurance Co. for refusing to settle the case before it went to trial. Before he was killed by a drunk driver, Wilson was a bus driver for the Southeastern Pennsylvania Transportation Authority. He is survived by two children, ages 6 and 3, and their mother to whom he was engaged to be married.
